1.2. How is a situation of gender-based violence accredited?

(Arts. 23, 26 and 27.3 of Organic Law 1/2004 of 28 December, on Comprehensive Protection Measur es against Gender-based Violence)

Generally, a situation of gender-based violence which gives rise to the recognition of the correspond ing rights is accredited with the judgement finding the accused guilty as charged, the court protection order in favour of the victim and, exceptionally, pending the court protection order, the report from the Public Prosecutor’s Office pointing to existing evidence that the claimant is a victim of gender-based violence.

However, the specific regulations on certain rights establish the means by which the situation of gender-bas ed violence is accredited.
